18. What does a contractor have to do to show a "good faith" effort to achieve the DBE or SBE goal?
To show a “good faith” effort, the contractor must either show that it has committed to subcontract to DBEs or SBEs at a level that achieves the goal or show “good faith” efforts to achieve the goal. Generally, to show a “good faith” effort, the contractor must show efforts to contact and encourage participation by DBEs and/or SBEs that are significant enough to demonstrate that the contractor was clearly trying to encourage participation. Examples are calls, e-mails, faxes, mailings, meetings and similar efforts made in such a manner and far enough in advance of the bid date to allow the DBE or SBE a meaningful opportunity to participate in the bidding process.
The determination that satisfactory efforts were made to fulfill the requirement of a "good faith" effort will be at the discretion of the NTTA.
