16. Do contractors always have to guarantee that they will subcontract a certain percentage of the contract to DBEs or SBEs?
No. Contractors must show “good faith” efforts to achieve the goal either by actually achieving the goal or by demonstrating that satisfactory efforts were made to achieve the goal. The determination that satisfactory efforts were made to achieve the goal will be at the discretion of the NTTA.
